Terms of Service

1. Who we are

Kwiz.ly ("Kwizly", "we", "us" or "our") is a real-time quiz platform operated in Finland. These Terms of Service ("Terms") govern your access to and use of the Kwizly website, applications and related services (together, the "Service"). By creating an account, hosting a quiz, or joining a quiz as a player, you agree to these Terms.

2. The Service

Kwizly lets hosts create quizzes and run live, real-time sessions that other people ("players") can join using a code or link, typically without needing an account of their own. We may change, add to, or remove features of the Service at any time.

3. Accounts

To create and host quizzes you need an account, either with an email address and password or by signing in through a supported third-party provider (Google, Facebook or GitHub). You're responsible for keeping your login credentials secure and for all activity that happens under your account. You must provide accurate information and keep it up to date. You must be at least 16 years old to create an account; see Section 10 of our Privacy Policy regarding children's data.

4. Joining quizzes as a player

Players can join a live quiz session by entering a display name — no account is required. We automatically filter and limit display names, but hosts and players are still responsible for the names and any free-text answers they submit during a session. Don't use a display name or submit content that is abusive, impersonates someone else, or is otherwise unlawful. Hosts remain responsible for the conduct of the sessions they run, including who they invite and what player data (such as names) is appropriate to collect in their context — for example, in a classroom setting we recommend hosts ask players to use first names or nicknames only.

5. Acceptable use

You agree not to use the Service to:

• Upload or transmit content that is illegal, defamatory, hateful, obscene, or infringes someone else's rights;
• Harass, bully, or impersonate any person;
• Attempt to gain unauthorized access to the Service, other accounts, or our infrastructure;
• Interfere with or disrupt the integrity or performance of the Service, including automated scraping or abuse of our APIs;
• Use the Service to collect personal data about players beyond what's needed to run a quiz session.

We may suspend or terminate accounts or sessions that violate these Terms.

6. Your content

You retain ownership of the quizzes, questions, images and other material you create or upload ("your content"). By uploading content, you grant us a worldwide, non-exclusive license to host, store, reproduce, and display it solely to operate and provide the Service to you and the players you invite. You're responsible for making sure your content doesn't infringe anyone else's rights and that you have permission to use any media you upload.

7. Plans, subscriptions and billing

Kwizly offers free and paid subscription plans with different feature limits. Paid plans are billed in advance on a recurring basis through our payment processor, Stripe. By subscribing to a paid plan, you authorize us to charge your chosen payment method automatically each billing period until you cancel. We do not store your full payment card details — these are handled directly by Stripe.

You can cancel a subscription at any time; your plan will remain active until the end of the current billing period, and we don't provide refunds for partial periods except where required by law. We may change our pricing or plan features, and will give you reasonable notice before any change takes effect for existing subscribers.

8. Third-party services

The Service relies on third-party providers, including sign-in providers (Google, Facebook, GitHub), payment processing (Stripe), transactional email delivery (Resend), and cloud storage for uploaded media. We aren't responsible for outages or issues caused by these third-party providers, though we'll do our best to keep the Service running smoothly around them.

9. Intellectual property

The Kwizly name, logo, and the Service itself (excluding your content) are owned by us or our licensors and protected by intellectual property laws. These Terms don't grant you any right to use our branding without our permission.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, or if we discontinue the Service. On termination, your right to use the Service ends, though some provisions of these Terms (such as ownership, disclaimers, and limitation of liability) will continue to apply.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We don't guarantee the Service will be uninterrupted, secure, or error-free.

12. Limitation of liability

To the fullest extent permitted by law, Kwizly and its operators won't be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, and our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service, your content, or your breach of these Terms.

14. Governing law

These Terms are governed by the laws of Finland, without regard to its conflict of law principles. Any disputes will be handled by the courts of Finland, unless applicable consumer protection law gives you the right to bring a claim in your own country of residence.

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll notify you by email or through the Service before they take effect. Continuing to use the Service after a change takes effect means you accept the updated Terms.
